Documents required for a property purchase in Spain
If you are considering buying a property in Spain, here are the main documents you will need to collect to complete your project :

1. The NIE: (Número de Identificación de Extranjero ) is a Spanish tax identification number for foreigners. It is compulsory for any real estate transaction in Spain. You can obtain it from the Spanish consulate in your country of origin or in Spain with an appointment (Online ).
2. The reservation contract (Contrato de reserva ) : This contract allows you to reserve the property you wish to buy. It must be signed by both parties and accompanied by a deposit (often between 3000 and 5000 euros). It is recommended that a lawyer be involved in the drafting and signing of this contract. This contract allows the property to be blocked for the time needed to check the administrative documents of the property before signing the deposit contract (between 14 days and one month on average)
3. The deposit contract (Contrato de arras ) : When the various documents have been checked by the lawyers or estate agents and the sale of the property does not have any administrative problems, the deposit contract can be signed, which is generally 10% of the value of the property (including the reservation). It is recommended that a lawyer be involved in the drafting and signing of this contract.
4. The nota simple: This document requested from the property registry certifies that the property has no outstanding debts or mortgages and also verifies the identity of the sellers and the description of the property.
5. Town planning certificate: This document certifies that the property complies with thetown planning regulations in force.
6. Energy certificate: This document is mandatory for all property transactions in Spain. It attests to the energy performance of the property.
7. Statements of charges: These cover current charges (electricity, water, gas, etc.), condominium charges, and taxes (IBI - property taxes) and must be up to date. It is recommended that you hire a lawyer to accompany you throughout the process of buying a property in Spain, to ensure that all the necessary documents are gathered and checked. The notary fees expected in the Valencian Community are 10% (ITP- Taxes) + about 2% of notary fees, registration fees and varioustaxes.
